Mohela Student Loan Forgiveness: What are the allegations?

Lawsuits and a critical study from two education organizations accuse a Missouri-based quasi-governmental organization servicing student loans of serious misconduct that caused students to lose thousands of dollars unnecessarily.

The American Federation of Teachers and the Student Borrower Protection Center issued a 47-page investigation report Wednesday outlining allegations made toward the Missouri Higher Education Loan Authority, or MOHELA. 

The report claimed that four out of ten MOHELA borrowers had experienced “servicing mistakes,” including untreated queues of loan forgiveness applications, payment errors, and improper denials of applications.

What actions support the allegations?

Two legal actions support the allegations. The U.S. Department of Education and MOHELA are the targets of a second class-action lawsuit filed in January, which claims “delays” from both organizations. The first, issued in December, solely names MOHELA as a defendant.

The two lawsuits allege that MOHELA’s “poor performance to properly process and deliver decisions for student loan borrowers” affected individuals all over the country. They were submitted to the United States District Court for the Eastern District of Missouri.

According to the investigation, MOHELA has benefited from an accumulation of PSLF applications: almost one million unexamined forms awaiting consideration from officials grew as a result of the company’s actions. It claims that servicers miscalculated the number of payments borrowers had to make in order to be entitled to full assistance and falsely informed certain borrowers they weren’t qualified for the program.

The executive director of the Student Borrower Protection Center, Mike Pierce, stated, “We have plenty of proof to demonstrate that something unethical is occurring in Missouri.”

The company described the charges as baseless, deceptive, and “nothing except a PR campaign.”

Which borrowers Must Know Regarding Changes in Student Loan Forgiveness? 

Only a small percentage of borrowers who were discharged within the past year are seeing student loan forgiveness reversals; this could be because of a mistake on PSLF labor certification paperwork. 

If only a small number of borrowers were able to have their forgiven debt resurrected, it would barely account for 0.0125% of the almost four million borrowers who have been authorized for student loan forgiveness. 

Because borrowers might have acted on the announcement of departure, which could have caused severe financial injury, the situation is grave and concerning.

Had Forgiveness of Student Loans Enhanced in the PSLF? 

The Public Service Loan Forgiveness program seems to be the focal point of the reversals.
